Terms and Conditions

GPU Upgrade Promotion for Eligible Customers

PLEASE READ THIS IN ITS ENTIRETY BEFORE MAKING A PURCHASE

Subject to the following terms and conditions, the GPU Upgrade Promotion for Eligible Customers (the “Promotion”) is open to end-users (private individuals and representatives of companies, partnerships and sole proprietorships) located or residing in the United States (including the District of Columbia) France, Germany, or the United Kingdom (the “Territory”) that purchase Eligible AMD Products (as set forth below) from an AMD Authorized Reseller (as set forth via the link provided below) during the Promotion Period (as defined below) for use and not for resale (each such private individual or representative of a company, partnership, or sole proprietorship referred to herein as an “Eligible Customer”). An Eligible Customer may not be controlled in whole or in part by an employee of Advanced Micro Devices, Inc. or its controlled subsidiaries (collectively “AMD”), Outbound Field Marketing Services Ltd. (the fulfilment agency), any authorized reseller of AMD products (an “AMD Authorized Reseller”), or an immediate family member (parent, child, sibling or spouse, regardless of where they live, or persons living in same household, whether related or not) of such employee.

LIMIT: Maximum of 5 claims per Eligible Customer, regardless of the number of Eligible AMD Products purchased or the number of Authorized AMD Resellers from whom Eligible AMD Products are purchased.

PROMOTION PERIOD: Begins on 15 May 2024 and ends on 30 September 2016.

CLAIM SUBMISSION END DATE: 31 October 2016.

RESTRICTIONS ON ELIGIBLE AMD PRODUCT PURCHASES:

a. Eligible Customers must purchase an Eligible AMD Product, either as standalone component or as part of a workstation system (provided that the Eligible AMD Product incorporated within such workstation system is clearly printed in the official tax invoice/system specifications), during the Promotion Period from an AMD Authorized Reseller located in the Territory. A listing of AMD Authorized Resellers participating in the Promotion is available at http://www.fireprographics.com/promo/us/buy.asp.

b. Upon timely purchase of an Eligible AMD Product, an Eligible Customer must visit the Promotion redemption site ( http://www.fireprographics.com/promo/us/claim.asp) and complete the rebate claim form. As part of this submission, the Eligible Customer must include a verifiable form of the receipt of purchase obtained from the AMD Authorized Reseller (e.g., scanned copy of the receipt or invoice). Claims submissions for rebate must be submitted no later than the Claims Submission End Date. Any claim submissions received thereafter are VOID.

An Eligible AMD Product purchased by an Eligible Customer from an AMD Authorized Reseller in accordance with these offer terms and conditions shall be entitled to a maximum rebate (in the form described herein) equal to the lesser of (a) the percentage indicated above in the “Per Unit Maximum Rebate” of the actual amount paid per unit of Eligible AMD Product, excluding taxes (as indicated in the original point-of-sale receipt or invoice), or (b) the amount indicated above as the “Per Unit Maximum Rebate” (EUR, GBP or USD, depending on the currency of purchase).

FORM OF REBATE:

UK, Germany, France and USA. The rebate will take the form of a virtual pre-paid credit card which can only be used for online purchases.

1. Form of rebate is subject to AMD’s sole discretion. Pre-paid MasterCards may be subject to their own terms and conditions and fees. Cardholders must be over 18 years old.

By way of example: (i) if an Eligible Customer purchased an AMD FirePro W2100 card during the Promotion Period for $90, the Eligible Customer would be entitled to a rebate award of $9; (ii) if another Eligible Customer purchased the same card for $150, that Eligible Customer would be entitled to a rebate award of $15, and (iii) if a third Eligible Customer purchased the same card for $200, that Eligible Customer would be entitled to a rebate award of $15. Amounts shown in this example are subject to the restrictions on the form of the rebate set forth above.

OTHER RESTRICTIONS AND LIMITATIONS:

a. Allow forty-five (45) days for processing of online virtual pre-paid credit cards.

b. Return or reselling of the Eligible AMD Product after submission of claim form voids the offer, and AMD reserves the right to disqualify, “stop payment,” or demand return of any funds awarded to the Eligible Customer if it determines that the Eligible AMD Product purchased pursuant to a rebate redemption request was returned or resold.

c. Any tax liability or reporting obligation related to any rebate award is the sole responsibility of the Eligible Customer.

d. AMD, Outbound Field Marketing Services Ltd., and their respective affiliates, subsidiaries, employees, directors, and agents are not responsible, to the extent permitted by law, for: (1) any incorrect or inaccurate information, however and by whomever caused, printing errors or omission, or by any of the equipment or programming associated with or utilized in the Promotion; (2) technical failures of any kind, including but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the application or reporting process or the offer; or (4) technical or human error that may occur in the administration of the Promotion or any processing of information related thereto. AMD, Outbound Field Marketing Services Ltd. and their respective affiliates, subsidiaries, employees, directors, and agents are not bound by and will be under no liability for, any statement by any retailer in conflict with these terms and conditions including but not limited to statements regarding the eligibility of any particular product the availability of remaining Promotion rebate funds, or the duration of the Promotion Period.

DISPUTES: Except where prohibited, a claimant (whether determined to be an Eligible Customer or otherwise) agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Promotion shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the Western District of Texas or the appropriate Texas State Court located in Travis County, Texas; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs wholly related to this Promotion, but in no event attorneys’ fees; and (3) under no circumstances will any claimant (whether determined to be an Eligible Customer or otherwise) be permitted to obtain awards for, and hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Terms and Conditions, or the rights and obligations of any claimant (whether determined to be an Eligible Customer or otherwise) and AMD in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the State of Texas without giving effect to any choice of law or conflict of law rules (whether of the State of Texas or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than the State of Texas. Some jurisdictions do not allow for limitations of certain remedies or damages and so this provision may not apply to you.

PERSONAL INFORMATION: Personal information collected as part of this Promotion includes the full name of the private individual or representative of a company, partnership, or sole proprietorship, company name (if applicable), email address, postal address, country, and state or province will be used to: (a) contact the claimant/Eligible Customer; and (b) if a claimant elects to receive additional information from AMD on the submission form, to send additional information to that claimant. All personal information submitted as part of this Promotion will be processed and collected by, transferred to, and stored at a destination outside the European Economic Area, in particular to Advanced Micro Devices, Inc. in the United States, for the purpose of the management of the Promotion and the allocation of the rebates. By submitting personal information, you agree to such transfer, storing or processing in accordance with Advanced Micro Devices, Inc.’s privacy policy, available at http://www.amd.com/en-us/who-we-are/privacy. Your tel. contact number and DOB will also be required for virtual pre-paid credit card payment. All personal information will be shared with Bread4Business – the company providing the virtual pre-paid credit cards.
